Final report on Grenfell Tower fire released
06 September 2024UK: The six-year public inquiry into the Grenfell Tower fire, which claimed 72 lives in 2017, has issued its final report, finding fault with ‘dishonest’ companies, as well as former governments and a disorganised response from the fire service. The inquiry criticised the role of cladding manufacturers, notably US-based Arconic, for its ‘systematic dishonesty’ in concealing the true fire hazards of its products. Arconic, which produced the Reynobond 55 polyethylene cladding used on Grenfell Tower, was accused of having hidden ‘very poor’ fire safety test results from the public and certification bodies. In the report, the cladding is described as ‘extremely dangerous’ when used in folded cassette form, and was ‘by far the largest contributor’ to the Grenfell fire.
The inquiry also named both Celotex and Kingspan as contributors to the incident. Celotex was accused of making ‘false and misleading claims’ by presenting its product to cladding contractor Harley Facades as being safe and suitable for Grenfell, even though ‘it knew that was not the case.’ Insulation producer Kingspan reportedly ‘misled the market’ by not revealing the limitations of its product, which was used on a small section of the building. In response to these findings, the inquiry has called for a revision in testing materials and designs for fire safety, advocating for transparency by making these test results publicly accessible. The findings of this inquiry lay the groundwork for potential criminal charges, with police and prosecutors indicating that investigations will continue until the end of 2025, and decisions on criminal charges expected by the end of 2026, according to a report by the BBC.
Kingspan said in a statement “We welcome the publication of today’s report which is crucial to a public understanding of what went wrong and why. It explains clearly and unambiguously that the type of insulation (whether combustible or non-combustible) was immaterial, and that the principal reason for the fire spread was the PE ACM cladding, which was not made by Kingspan. Kingspan has long acknowledged the wholly unacceptable historical failings that occurred in part of our UK insulation business. These were in no way reflective of how we conduct ourselves as a Group, then or now. While deeply regrettable, they were not found to be causative of the tragedy and Kingspan has already emphatically addressed these issues.”
A spokesperson for Celotex said “The publication of the Grenfell Tower Inquiry report marks the conclusion of the inquiry’s work and we are considering its contents with care. This review was a significant and thorough undertaking, and the results of that work were disclosed promptly and proactively to relevant stakeholders, including the Grenfell Tower Inquiry. Independent testing commissioned following the review demonstrated that the cladding system described in the Celotex RS5000 marketing literature met the relevant safety criteria. That system was substantially different to that used at Grenfell Tower. Decisions about design, construction and the selection of materials for the Tower were made by construction industry professionals.”
A spokesperson for Arconic subsidiary Arconic Architectural Products (AAP), which Building News reports supplied aluminium composite material used for the rainscreen at Grenfell Tower, said “The company respects the Inquiry process. AAP cooperated fully with the work of the Inquiry and will continue to engage with further legal processes. Together with other parties, AAP has made financial contributions to settlements for those affected, as well as to the restorative justice fund. Throughout the Inquiry, AAP has maintained a number of points: AAP sold sheets of aluminium composite material as specified in the design process. This product was safe to use as a building material, and legal to sell in the UK as well as the more than 30 other countries in which AAP customers purchased the product. We reject any claim that AAP sold an unsafe product. AAP regularly conducted tests of its materials using third-party testing bodies. Reports on these results were all publicly available, and AAP made these reports available to its customers. AAP did not conceal information from or mislead any certification body, customer, or the public.”
Kingspan disputes possible EU fine
21 March 2024Ireland: Kingspan has contested the European Commission (EC)'s preliminary findings from its investigation of the company’s abandoned attempt to acquire Slovenia-based Trimo in 2021. The Commission preliminarily found that Kingspan negligently or intentionally provided incorrect, incomplete and misleading information during the merger review. The relevant information reportedly pertained to Kingspan’s internal organisation, market scope, barriers to entry and expansion and competition closeness with Trimo. The Irish Independent newspaper has reported that applicable fines may be up to 1% of Kingspan’s annual global turnover.
Kingspan disputed the preliminary findings and will now formulate a response. In a statement, the company said “Kingspan has fully co-operated with the commission throughout the period relating to the Trimo process, which commenced in September 2020, continued until Kingspan withdrew from the process in April 2022, and was followed by the EC's investigation, which opened in November 2022. This Trimo application was unusual and uniquely onerous given both the level of information sought and the fact that the process occurred during the Covid-19 outbreak. It is in no way representative of the long and productive relationship Kingspan has with the EC. Since the Trimo process began in 2020, Kingspan has secured four successful clearances, supporting investments by Kingspan in energy-efficient and low-carbon buildings that are essential to the EC's green transition."
Indonesia: The Indonesian Safeguards Committee started an investigation into slag wool, rock wool and similar mineral wools (including intermixtures) in bulk, sheets or rolls from late July 2023. It scheduled a hearing in mid-August 2023 for interested parties - such as importers and exporters - to present their views and evidence on the matter.
A safeguard investigation seeks to determine whether increased imports of a product are causing, or threatening to cause, serious injury to a domestic industry. A World Trade Organisation member may take a safeguard action, including the temporary restriction of imports, only if the increased imports of the product are found to be causing, or threatening to cause, serious injury.
UK: Insulation and cladding companies have blamed each other in a public inquiry investigating the Grenfell Tower Fire that took place in 2017 that led to 72 deaths. During closing statements to the inquiry the Press Association reports that the legal representation for Ireland-based Kingspan said, "In its phase one report the inquiry concluded that the cladding system on Grenfell Tower did not comply with the building regulations and that the PE ACM [polyethylene cladding] manufactured by Arconic was the principal reason for the rapid fire spread." The lawyer went on to summarise that Kingspan’s Kooltherm K15 phenolic insulation product was safe when used appropriately and not relevant to the nature and speed of the spread of the fire in this instance.
In a written statement though Arconic blamed the cause of the fire upon the failure by those involved in the refurbishment of the tower in assessing the fire performance of the building materials used and their configuration. It added, "A failure which was in significant part the result of the efforts made by the manufacturers of the insulation, Celotex and Kingspan, to hide or downplay the combustible and hence (under the prevailing regulatory regime) non-compliant nature of their product, an awareness of which would otherwise and in any event have led inexorably to the choice and configuration of the components being re-visited and amended."

Former insulation product manager admits Celotex manipulated fire safety tests in Grenfell Tower inquiry
19 November 2020UK: Jonathan Roper, a former assistant product manager at Celotex, has described the company as ‘dishonest’ by ‘overengineering’ a cladding fire safety test to achieve a pass for its RS5000 insulation product. After a first test failure in January 2014, a second system passed in May 2014, which the firm used to erroneously market the combustible rigid foam boards as being safe for use on high-rise buildings, the inquiry has heard, according to the Press Association. Covert changes were allegedly made to the set-up of the second test to make the outcome more favourable. Roper added that the motivation for getting the RS5000 product to market was to compete with rival firm Kingspan and its K15 insulation.
Celotex, part of the French multinational Saint-Gobain group, has maintained it promoted RS5000's use on buildings taller than 18m only on a "rainscreen cladding system with the specific components", used when it passed the fire safety test. The inquiry has previously heard Celotex saw Grenfell as a "flagship" for its product and exploited the "smoke of confusion" which surrounded building regulations at the time.
The current stage in the inquiry is examining the production, testing and sale of the materials used in the tower's refurbishment which resulted in the June 2017 fire, killing 72 people. The proceedings continue.
Kingspan withdraws fire test reports for Kooltherm K15 in the UK
12 November 2020Ireland: Kingspan has written to the Building Research Establishment (BRE) to withdraw fire test reports on its rigid thermoset phenolic insulation Kooltherm K15. The Irish Times newspaper has reported that, speaking at the inquiry into the Grenfell tower fire in London, a representative of the company admitted that the fire test reports on Kooltherm K15 may not reflect the actual product. This was due to possible compositional changes arising from “process shortcomings” that “fell short of the high standards which Kingspan sets itself." In 2007 it failed a fire test in which it was reportedly tested with a cladding system that also failed subsequent testing with another company’s insulation.
The Grenfell inquiry has asked Kingspan why it had not previously withdrawn the Kooltherm K15 fire test reports with the BRE. A distributor supplied the insulation to contractors for use in the refurbishment of Grenfell in 2012 – 2016.

Subcontractors planned Grenfell Tower insulation as a case study
23 September 2020UK: A public inquiry has heard that Grenfell Tower cladding subcontractor Harley Facades and staff of Saint-Gobain subsidiary Celotex discussed the use of Celotex’s RS5000 polyisocyanurate foam (PIR) insulation as a “case study” to determine “the U-value achieved by the product.” The insulation product was also sold to the contractor at a 48% discount. Ben Bailey, project manager at Harley Facades, denied that the price had anything to do with the final choice of product for the project. However, other documents showed that Harley Facades staff also enquired about the price of a Kingspan K15 insulation product.
In January 2020 Stephanie Barwise Q.C. told the inquiry that Celotex treated the 67m tall building as a "flagship" project for its RS5000 insulation product.

UK: The UK government plans to adopt the recommendations made by Dame Judith Hackitt in her review of building regulations and fire safety published following the Grenfell Tower fire in mid-2017. Other commitments the Ministry of Housing, Communities & Local Government has made include creating a new regulatory and accountability framework to provide greater oversight of the industry and introducing clearer standards and guidance, including establishing a new Standards Committee to advise on construction product and system standards and regulations. It says it will place residents at the heart of the new system, with new routes for engagement and redress, and that it wants to help create a culture change and a more responsible building industry. In addition to setting out its plans to implement the changes called for by Hackitt, the government says that a full review of fire safety guidance within building regulations has also been launched.
UK: An investigation by the BBC’s Panorama news program has alleged that a safety test for Celotex’s RS5000’s polyisocyanurate foam (PIR) insulation board product used extra fire retardant in safety tests. The programme believes that a different product was eventually sold to the public. It also accused the subsidiary of Saint-Gobain of mis-selling the insulation with misleading marketing.
Celotex said that it was unaware of this allegation and had not identified anything that would support it. It is investigating this allegation as a ‘matter of urgency.’ It added that it had not used any special formulation for a recent successful BS-8414 system test in May 2018 or Class 0 fire testing.
Celotex suspended supply of RS5000 PIR insulation board in June 2017 following its use as part of the rainscreen cladding system in the refurbishment of Grenfell Tower. The building had a fire in June 2017 that killed 72 people.
UK: A review by the government into building regulations and fire safety has found that the local buildings regulation system is broken, However, it has not recommended a ban on combustible cladding, according to Reuters. The independent review followed a fire at a residential tower block in June 2017 that killed 71 people. An aluminium cladding with a flammable plastic core is thought to have contributed to the rapid spread of the fire.
Judith Hackitt, the engineer and former Chair of the UK Health and Safety Executive presiding over the review, defended existing regulations and blamed poor implementation of the rules by builders and contractors. She has recommended that the building regulations system be changed to focus on high-rise residential buildings first and then to improve building safety during design, constriction and refurbishment. She also called for greater enforcement powers with ‘serious’ penalties for individuals who infringe the rules.
Organisations including Kingspan Insulation, Knauf Insulation, the Mineral Wool Insulation Manufacturers Association and the Constructions Products Association provided written evidence to the review.
A separate public inquiry is examining the causes of the Grenfell Tower fire and a police investigation is also looking at the incident.
